Electronics Import Duty, Without the Hand-Waving

A phone clears US customs at 0%. A bare circuit board from the same factory can owe 25%. Same box, same flight, completely different bill. Here's what actually drives the number — and where the traps are.

Before you trust any rate
Every percentage below is a typical figure for a common HTS subheading. Electronics classification turns on details — panel type, battery capacity, whether the thing transmits RF. Why "electronics duty" isn't one number

Most people come in asking "what's the duty on electronics?" as if it were a single tariff. It isn't, and the gap between the cheapest and most expensive items in this category is the whole story of importing electronics.

The reason is structural. Finished consumer IT products — phones, laptops, tablets — sit under the WTO Information Technology Agreement (ITA), which commits the US and ~80 other members to zero or near-zero tariffs on them. But the ITA covers finished products, not the parts that go into them, and not every accessory. So a smartphone is free; the bare PCB inside it can be 25%; the USB-C cable in the box might be 2.5%. Three items, one shipment, three very different outcomes.

That split is why this page is organized by what the product is and where it comes from, not by a single fake "electronics rate."

The HS chapters that actually show up

If you're classifying electronics for import, you'll live in three chapters of the tariff schedule:

The first six digits of any of these codes are harmonized globally. Digits seven through ten are US-specific and they're where your real rate is decided. Two products that look identical can land in different 10-digit codes and owe different duty — which is exactly why "it's all electronics" is the wrong way to estimate.

Duty by product type — the real spread

This is the part that surprises new importers. The rates below are representative of common US HTS subheadings; treat them as a map, not a quote.

Phones, laptops, tablets: usually 0%

Smartphones (8517.12) and portable computers (8471.30) are ITA products and most models enter the US at a 0% MFN rate. The complication isn't the base rate — it's Section 301 if the origin is China (more on that below). For non-China origins, a phone is about as cheap to import, duty-wise, as anything in the book.

Audio, accessories, gadgets: 0–3.5%

Headphones and earbuds (8518.30) typically run 0–2.6%. Chargers, power banks, and miscellaneous devices (8543.70) often sit around 2.5%. Cables, cases, and dongles — the stuff bundled with a "free" device — are frequently classified on their own and can owe more than the device they ride in with. Itemize your packing list by subheading; don't let a broker lump "accessories" into one line.

Bare PCBs and networking gear: the expensive end

Here's the trap. A bare or assembled printed circuit board (8534.00) is not an ITA product. Depending on layer count and material it runs 0–3% MFN — but for China origin it has historically carried the steepest Section 301 surcharges (List 1, 25%). Routers and switches (8517.62) sit in a similar gray zone where exclusions have been on-again, off-again. If your shipment is "mostly boards," check the live USTR exclusion list for your exact code before you quote a customer. The distance between 3% and 28% effective is not academic.

Batteries: classified apart from the device

A lithium-ion pack (8507.60) is its own HTS line, separate from the speaker or laptop it powers. That matters because batteries draw both a duty question and a shipping question — and the shipping question will stop your shipment long before customs ever sees it. See the lithium section below.

Duty by origin country — same product, different bill

Because Section 301 applies only to Chinese-origin goods, the country your electronics ship from can change the effective rate by 7.5 to 25 points. This is the single biggest lever most importers overlook.

One nuance worth flagging: "origin" means where the product was substantially transformed, not where it shipped from. A board fabricated in Taiwan, stuffed in China, and boxed in Vietnam is a classification question in its own right — and it can be the difference between owing Section 301 or not. Don't take the "Made in" line on the carton as gospel.

Compliance that isn't duty — but will stop the shipment anyway

Duty is the easy part. These are the rules that actually delay electronics at the border, and none of them show up in a duty calculator.

FCC: required for anything that transmits

If the device emits RF — Wi-Fi, Bluetooth, cellular — it needs FCC equipment authorization before it clears US customs. Intentional radiators (anything that transmits) need FCC Certification from a recognized lab. Devices that only emit RF as a byproduct can self-declare under Supplier's Declaration of Conformity (SDoC). No authorization, and CBP can detain the whole shipment. The importer of record is on the hook, not the factory — so check the test report yourself and match the model numbers. A report referencing a different model than your invoice is the single most common reason wireless electronics get held.

UL, Prop 65, and the retail fine print

UL listing isn't a CBP requirement, but major US retailers and Amazon categories often won't list a product without it — so for many importers it's effectively mandatory. California's Prop 65 applies if the product contains listed chemicals above threshold; the fix is usually a warning label, not a block, but skipping it invites lawsuits. If you sell direct to US consumers, budget for both.

Lithium batteries: a shipping rule, not a customs rule

If your goods contain lithium cells — and most modern electronics do — they're Class 9 dangerous goods for air freight. You need UN 38.3 test certification per battery model, a proper IATA dangerous-goods declaration, state-of-charge at 30% or below for air, and drop-test-rated packaging. None of this is CBP's concern; it's DOT/IATA, enforced by the airline and forwarder at origin. Miss it and the shipment never gets on the plane, so customs is moot. Sea freight is more lenient on the paperwork but the rules still apply. If batteries are most of your shipment weight, check the per-package caps (roughly 35 kg net for standalone cells, 5 kg packed with equipment) before you book.

The de minimis question — and why 2026 changed it

For years, a single electronics item under $800 entered the US duty-free under Section 321, cleared electronically in hours. That landscape shifted in 2025–2026: the blanket $800 exemption was rolled back, and the rules now depend on origin and current policy rather than a flat threshold. The US is no longer the outlier it once was, and the gap versus the UK (£135) and EU (€150) is narrower than it was.

How to actually estimate your landed cost

The honest workflow, in order:

  1. Pin the 10-digit HTS code. Guess the chapter, then confirm the subheading. This decides both the rate and whether Section 301 applies.
  2. Add freight and insurance to the goods value for a CIF figure. CBP uses CIF, not your FOB factory price, and it wants the exchange rate on the export date if you paid in another currency.
  3. Apply the duty rate (base MFN, plus Section 301 only if China-origin and no exclusion).
  4. Layer in compliance cost — FCC testing, battery shipping, broker fees — which often exceeds the duty line on a small shipment.

Frequently asked questions

What's the real duty rate on imported electronics?

There isn't one. Finished phones and laptops are typically 0% under the ITA; audio and accessories run 0–3.5%; bare PCBs and networking gear can hit 25% for China origin once Section 301 is added. The rate is set by your 10-digit HTS code, not by the word "electronics." Check the code before you trust any single percentage.

Why does a phone pay 0% but a circuit board pay 25%?

Because of which agreement covers which product. Phones and laptops are ITA products with bound zero tariffs; bare PCBs aren't ITA products and, for China origin, landed on Section 301 List 1 at 25%. The ITA zeroes the base rate but does nothing about Section 301. The net effect is a finished device that's free and the part inside it that's heavily taxed.

Do I need FCC certification to import electronics?

Only if the device transmits or emits RF — Wi-Fi, Bluetooth, cellular. Those need FCC equipment authorization (Certification for intentional radiators, SDoC for unintentional). Non-RF products like a basic power adapter or a wired keyboard don't. But "no FCC" doesn't mean "no rules": lithium batteries, Prop 65, and retailer UL requirements still apply.

Does shipping from Korea or Japan avoid the China tariffs?

Yes, on Section 301 specifically — that surcharge applies only to Chinese-origin goods. Korean electronics enter at 0% under KORUS; Japanese at roughly 1.5% MFN with no Section 301. But "origin" means substantial transformation, not the last port of load, so a product merely transshipped through a third country doesn't shed the China tariff. Confirm the transformation point, not just the shipping label.

Is the $800 de minimis still a thing for electronics?

Not the blanket exemption it was. The 2025–2026 reforms narrowed Section 321, and whether a sub-$800 electronics shipment clears duty-free now depends on origin and current policy rather than a flat $800 line. Re-check the 2026 reform page before relying on it — this changed recently and the old "just keep it under $800" playbook is stale.

Who's responsible for compliance — me or the factory?

You are. The importer of record is legally on the hook for FCC authorization, accurate classification, country-of-origin marking, and declared value, even if your supplier provided the test reports. Get the reports from the factory, but verify them yourself — model numbers, recognized lab, current validity. Customs doesn't care that "the supplier said it was certified."
